Oil Portrait Contract
I ________________________ agree to the following terms
to have a portrait completed by Jennifer Smith.
1. PHOTOS - I _____________________________, will supply
the photos from which Jennifer Smith will paint. I understand
that Jennifer Smith will do her best to return the photos in the
same condition that she received them. However, I also understand
that it is possible that they could get lost or damaged in the
mail or get paint on them so it is best to have copies made of
any photos before I send them or know where the negatives are.
I also guarantee that the photos supplied by me were taken by
me or a friend who has given me permission to have them painted.
2. THE PORTRAIT - I ________________________________,
understand that I am under no obligation to purchase the portrait
if for any reason I am not satisfied with the painting. If I don't
want the painting after it is shipped to me, I can ship the portrait
back to Jennifer Smith along with a check reimbursing Jennifer
for her cost of shipping the portrait to me (the receipt will
be enclosed with the painting) and Jennifer will return the initial
cost of the portrait to me. If I do not wish to purchase the portrait
for any reason before it is shipped to me, I understand that the
portrait can be sold to another party and the photos will be returned
to be (see item 1) and that no payment will be expected of me.
I agree to send $________ before the unframed painting is shipped
to me and that I will reimburse Jennifer Smith for shipping once
I receive the portrait. I am guaranteed an unframed oil painting
that is __________X________ inches that will be painted from the
sources that I will supply. I understand that I can make suggestions
for changes and Jennifer will do her best to comply. I can expect
to receive digital photos of the portrait as it is painted for
my approval. I also understand that the portrait can not be reproduced
by me with out written consent from Jennifer. In addition, I understand
that the image of the painting will be used for marketing purposed
by Jennifer Smith. And finally, I understand that the portrait
is a one of a kind item and that it is hand crafted so therefore,
there is no guarantee for finish time which is one reason that
there is no expectation of payment until the portrait is completed.
3. SHIPPING - I ________________________________, understand
that the cost of shipping is in addition to the cost of the portrait.
I will reimburse Jennifer for shipping once the portrait arrives
to me. The painting will be carried by UPS and I will receive
the tracking number after Jennifer ships it so I can track its
progress. I can expect that the portrait will be shipped and packed
by Mail Boxes Etc. and that it will be insured for the cost of
the painting. If the painting is lost or damaged, Jennifer Smith
will receive the insurance payment and that if I wish to have
another painting completed, I must sign another contract.
I agree to enter into this contract and I understand
that by signing this contract I agree to all of the conditions
stated in items 1 through 3.
